Did you know that over 95% of international data and voice transfers are routed through underwater cables? According to the NOAA, underwater cables “support critical commercial, economic, and national security endeavors” and “carry a majority of civilian, military, and government offshore communications traffic.” Because “national security and law enforcement threat environments have evolved significantly,” the Federal Communications Commission (“FCC”) is considering its “first major comprehensive review” of FCC submarine cable rules since 2001… On October 31, 2024, the FCC released a fact sheet stating that it may issue a notice of proposed rulemaking relating to the critical infrastructure of submarine cables. If approved in the FCC’s November 2024 meeting, the FCC will seek comments “on how best to improve and streamline the Commission’s submarine cable rules to facilitate efficient deployment of submarine cables while at the same time ensuring the security, resilience, and protection of this critical infrastructure.” This is the time for government contractors with relevant knowledge to speak up!! Among other things, the FCC will request comments on how to: 1. Update the “application requirements for national security purposes and to ensure the [FCC] has targeted and granular information regarding the ownership, control, and use of a submarine cable system”; 2. "[P]rotect submarine cable infrastructure, including activities in coordination with our federal partners”; 3. Update “submarine cable rules and certain targeted requirements to protect submarine cable systems from national security and law enforcement risks”; 4. Streamline “the FCC’s submarine cable review processes”; and 5. Improve “the quality of the Circuit Capacity data and facilitating the sharing of such information with other Federal Agencies.” Comments would be due 30 days after the date the proposed rule is published in the Federal Register.
